The form is genuinely fillable by anyone. The judgment calls are not on the form: whether the mark is registrable at all, which classes and descriptions cover how you actually trade, and whether something on the register will block you. Errors here surface a year later as objections and oppositions — the expensive stage.
A sensible division of labour
- Do yourself: shortlisting names, gathering usage evidence, knowing your business scope.
- Take help: clearance search and opinion, class/description drafting, prosecution responses.
- Either way: insist on a written scope and fee before anyone starts — never an open meter.
