The provisional is India's (and much of the world's) mechanism for "file first, perfect later". It buys twelve months of priority — time to validate, raise funds or refine — while your date holds against later filers.
What a good provisional needs
- Enough technical description that a skilled person could recognise the invention — a thin provisional protects only what it actually teaches.
- Drawings and at least one worked example, wherever possible.
- A calendar entry for month nine: drafting the complete specification takes time.
One caution: publicly disclosing the invention before any filing can destroy patentability in most countries. File before you pitch, demo or sell.
